Terms of Service

AskOnward is an AI assistant that helps users navigate the Bureau of Internal Revenue (BIR) rulebook. It is operated by Smart I.T Solutions Inc.(“we”, “us”, “our”). AskOnward is an independent product and is not affiliated with, endorsed by, or representing the BIR or any government agency.

You must be at least 18 years old and able to enter into a binding contract under Philippine law to use AskOnward. You agree to provide accurate information when signing up and to keep your account credentials confidential. You are responsible for all activity that takes place under your account.

You may close your account at any time by contacting us. We may suspend or terminate your account if you breach these Terms, abuse the Service, or use it in a way that could expose us or other users to legal risk.

AskOnward offers a free preview and paid access for the full answer. Pricing is shown in the Service before you pay. Payments are processed by PayMongo Philippines, Inc. and are subject to PayMongo's own terms.

Unless explicitly stated otherwise, paid access is granted on a one time or subscription basis as described at the point of purchase. Taxes, if applicable, will be added at checkout or included in the stated price.

Because answers are delivered immediately upon successful payment, paid access is generally non refundable once an answer has been unlocked. If you were charged in error, if the Service failed to deliver an answer due to a problem on our side, or if you have not consumed any paid feature, contact sales@sitsolutionsinc.com within seven (7) days of the transaction and we will review your request in good faith.

AskOnward is an information tool. Answers are generated by a large language model and grounded in the publicly available BIR rulebook. It may be incomplete, outdated, or wrong. Nothing in the Service constitutes legal, tax, accounting, or professional advice, and no client or fiduciary relationship is created between you and Smart I.T Solutions Inc. by your use of the Service.

Always verify critical requirements, deadlines, fees, and forms with the BIR directly or with a qualified professional before taking action.

You agree not to:

• use the Service in violation of any applicable law or regulation;
• attempt to reverse engineer, decompile, or extract the source code of the Service, or to bypass any access control or rate limit;
• use automated means to scrape, harvest, or copy material from the Service beyond what is permitted by these Terms;
• submit content that is unlawful, defamatory, harassing, discriminatory, or that infringes another person's rights;
• upload personal data of other individuals without lawful basis;
• use the Service to build or train a competing product, model, or dataset; or
• interfere with the security or integrity of the Service or the infrastructure that supports it.

The Service, including its software, design, branding, prompts, and generated user interface, is owned by Smart I.T Solutions Inc. and is protected by Philippine and international intellectual property laws. Source material from the BIR rulebook remains the property of the Government of the Republic of the Philippines.

We grant you a limited, non exclusive, non transferable, revocable license to use the Service for your personal or internal business purposes, subject to these Terms.

You retain ownership of any input you provide. You grant us a worldwide, royalty free license to host, process, transmit, and display your input to operate and improve the Service.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand how we collect and use your information.

The Service relies on third party providers such as Supabase, Vercel, an AI Gateway, and PayMongo. We are not responsible for the availability, accuracy, content, or practices of these providers. Your use of their products is governed by their own terms.

We work hard to keep the Service available, but we do not guarantee that it will be uninterrupted, error free, or available at all times. We may modify, suspend, or discontinue the Service, or any feature of it, at any time, with or without notice.

To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory, or otherwise. We specifically disclaim any warranties of merchantability, fitness for a particular purpose, accuracy, and non infringement. AskOnward is not a substitute for professional advice or for direct dealings with the BIR.

To the maximum extent permitted by law, Smart I.T Solutions Inc., its directors, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, goodwill, data, or other intangibles, arising out of or in connection with your use of the Service, even if advised of the possibility of such damages.

In any case, our total aggregate liability for any claim arising out of or related to the Service shall not exceed the greater of (a) the total amount you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) one thousand pesos (PHP 1,000).

You agree to defend, indemnify, and hold harmless Smart I.T Solutions Inc. and its affiliates from any claim, liability, damage, loss, or expense, including reasonable attorney's fees, arising out of or related to your use of the Service, your content, or your breach of these Terms.

These Terms are governed by the laws of the Republic of the Philippines, without regard to its conflict of laws rules. Any dispute arising out of or in connection with these Terms shall be brought exclusively before the competent courts of Makati City, to the exclusion of any other venue.

We may revise these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you by email or through the Service. Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms.
